Greater Flexibility for Long Service Leave

Permanent amendments have now been made to Long Service Leave Legislation in NSW to provide greater flexibility for employers and employees. The amendments will:

  • Enable an employer and a worker to agree to the employee taking long service, either in advance or accrued of periods not less than 1 day;
  • Provide workers who do not have fixed hours, with the means to calculate how many hours constitutes 1 day’s work;
  • Shorten the period of employer notice for proposed leave to less than 1 month if this is agreed to by the worker; and
  • Provide that employers keep long service records for 6 years.

Contract cleaners also now have reduced waiting periods for access to long service to 10 weeks, instead of 20 weeks under the Portable Long Service Leave provisions.
