Is an employee is entitled to payment of annual leave loading on annual leave paid on termination of employment? The Federal Court has settled this long disputed issue in finding that where an employee had an entitlement to annual leave loading (or where applicable shift/weekend penalties) when they took annual leave during employment, that entitlement also exists in paying out accrued annual leave upon termination of employment.
